1. We give 50% discount - Our lovely uniqe distributors are responsible of marketing & greatly representing our brand. All distributors are allowed to set their fair needed price in their own country. Jennyjahn.com webbshop will only sell to Swedish clients & not outside.

Retailers: Minimum order of 30 000Sek & 15pcs each product.

Exclusive Distributors: We give give exclusive rights in country, when selling for at least 140 000Sek/Year & minimum 60pcs/product each order.

2. Purchase Order

Your purchase order must include:

1. A PO number

2. A street address for receiving

3. Contact name and phone number

4. A line item description of your order.

3. Payment

Prepayment must be made when placing your order using:

1. Direct Bank wire transfer. The invoice will be EURO.

2. Paypal/Credit Card (will be added 4% fee.)

 

4. Shipping by DHL, Insured and tracked. We add 4% fee for all shipping. 

We pack our orders to minimize damage during shipping. If you have any damage to your products due to shipping, please contact us immediately to make arrangements. We always add insurance, this have been the very best method with complete order delivery around the world. Orders that cannot be delivered due to an incorrect physical address will incur a delivery charge to the customer's account. All customs fees are the responsibility of the customer.

 

5. Delivery & Production Time

15-45 business days to prepare create handmade fresh order and about 1-4 days shipping by DHL, depending on location. This allows you to store the products for maximum time in your store, we leave it to customer to order in a good time. The date of delivery specified by the Supplier is an estimate only.  Time for delivery shall not be of the essence of the contract and the Supplier shall not be liable for any loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods.

 

6. Cancellations and Returns

Once the order is shipped, it is the customer’s responsibility to pay for any extra import or extra shipping fees incurred. Unopened products in good condition may be returned upon approval from our office. Please contact us within 7 days of receiving your order to get approval for the return. We are not able to refund shipping charges. 

We are unable to accept returns of products that have been opened.

A 20% restocking fee applies to items that were shipped as ordered and are not damaged or opened.

 

7. Product Pricing

Exclusive Distributors: You are agreed to freely set any pricing needed in your country to be distributor to other companies and customers.

 

8. Limited Liability

Our company is not liable for any losses or damages caused from the use or application wrong of our products. Our liability is limited to replacement value of our products.

 

9. Non-Disclosure Agreement

All proprietary information regarding Our company and the Customer's products and business practices disclosed in the process of filling the customer's order is confidential between the Customer and Our company's staff. This information is protected and may not be disclosed to third parties by Our company or the customer.

 

10. Marketing Materials and Graphics

Our web site or any portion of our web site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose without express written consent of Jenny Jahn. You may use our logo or other proprietary graphic or trademark on your web site or printed materials with our written permission. 

 

11. Acceptance of Electronic Communication

By placing an order, you are consenting to receive communications from us electronically. We will communicate with you by e-mail to make sure we have all agreement correct and written down. You agree that all communications that we provide to you electronically satisfy any legal requirement.

 

12. Holidays information

We will be out of office 4 weeks in summer (jul/aug) and 2 weeks in winter (dec/jan). Any order needs to be placed by customer 30days business before holiday to make sure of a delivery.

13. Currency value

We will always follow market in raisings of currency, this means we could be needed to raise in any terms if market does. We keep rights to raise anytime needed for to cover cost of manufacturing and values.

 

14. Force majeure

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, the act or omission of government, highway authorities, forced close downs, or any telecommunications carrier, operator or administration or other competent authority, or the delay or failure in manufacture, production, or supply by third parties of equipment or services, and the party shall be entitled to a reasonable extension of its obligations after notifying the other party of the nature and extent of such events.

 

15. No Sales outside Territory- Exclusive distributor.

Distributor will not, directly or indirectly, sell or offer for sale, outside of the Territory any of the Products without the prior permission of our company. In return, we will ensure that outside entity sales into the Territory are prohibited specifically including Internet sales and shipments to Country.

 

16. Indemnification

The Customer shall indemnify the Supplier against all claims, costs and expenses which the Supplier may incur and which arise, directly or indirectly, from the Customer’s breach of any of its obligations under this Agreement, including any claims brought against the Supplier alleging that any goods and/or services provided by the Supplier in accordance with the Specification Document infringes a patent, copyright or trade secret or other similar right of a third party.

 

17. Assignment

The Customer shall not be entitled to assign its rights or obligations or delegate its duties under this Agreement without the prior written consent of the Supplier.

18. Independent contractors

The Supplier and the Customer are contractors independent of each other, and neither has the authority to bind the other to any third party or act in any way as the representative of the other, unless otherwise expressly agreed to in writing by both parties. The Supplier may, in addition to its own employees, engage sub-contractors to provide all or part of the services being provided to the Customer and such engagement shall not relieve the Supplier of its obligations under this Agreement or any applicable Specification Document.

Distributor shall indemnify and save Jenny Jahn Organic harmless of and from any liability or damages as well as all costs and expenses including, but not limited to, attorneys' fees and travel expenses, reasonably incurred by Jenny Jahn and/or its associate or affiliate companies in defending against any such claimed liability or damages. Distributor shall execute all documents required by us to carry the foregoing into effect.

 

18. Limitation of liability 

The entire liability of the Supplier to the Customer in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the price paid by the Customer to which the claim relates. In no event shall the Supplier be liable to the Customer for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage whatsoever. This shall apply even where such a loss was reasonably foreseeable or the Supplier had been made aware of the possibility of the Customer incurring such a loss.

 

19. Third parts

We are not responsible for any third part made agreement between customer and any other part. This contract is only between our customer and us. We keep the right at any time of misused agreements or contact disclose this contract immediately.

 

20. Governing law and jurisdiction 

This Agreement shall be governed by and construed in accordance with the law of Sweden and the parties hereby submit to the exclusive jurisdiction of the Swedish courts.

21. Funding of Advertising and Promotional Activities.

All costs and expenses incurred in marketing, promoting and advertising the Products in the Territory shall be exclusively borne and paid by Distributor.

​

22. No Repackaging.

Distributor will not as GMP by law, repackage, re-bottle, re-label, affix stickers or in any way modify the finished goods.  Distributor may re-label the Products as required by local laws.

​

23. Notice & Handling of Infringements.

Distributor shall advise Jenny Jahn Organic of any infringements in the Territory of Product trademarks, descriptions, trade names, copyrights or designs or any limitations of any Products of which it becomes aware. Jenny Jahn Organic shall have the sole right, though not the obligation, to take such steps as are reasonably necessary to protect Our rights, and Distributor shall assist and cooperate with us in enforcing such rights. Distributor agrees not to contact the third party, not to make any demands or claims, not to institute any suit, nor take any other action on account of such infringements or limitations without first obtaining the prior written permission of Jenny Jahn. Organic. With respect to all claims and suits, including suits in which Distributor is joined as a party, Jenny Jahn Organic shall have the sole right to employ counsel of it choosing and to direct the handling of the litigation and any settlement thereof. If Distributor desires to retain its own counsel, it shall do so at its expense. Any recovery as a result of such actions shall belong solely to Jenny Jahn Organic, except to the extent that such recovery represents actual damages suffered by Distributor.

24. Responsible use.

We only represent our own description in Sweden and we do not hold any responsible for any claims and remake of our descriptions or products. All our customers are 100% responsible to provide correct marketing, holding information, representation according to duties and laws in their country.

25. More Info.
No refunds will be issued for products with natural imperfections. Each batch is made fresh by our store. Like Mother Nature, no two plants are exactly the same; every plant has varying properties as a result of each year’s growth cycle, as affected by rain, sun, etc. Our products may show some variation from batch to batch. The quality and components of the product will be the same, however, colour, texture, and scent may vary. There may be a slight separation in some of your products since no chemicals are added to bind everything together. Simply stir the product before use. The quality of your product is in no way affected by this separation. If any issues with separation, we will solve together a best way to change delivery and replace products.

26. Equal rights for both parts of disclosure.

Both supplier and distributor have equal rights to any time discontinuing partnership for any given reason.

When a product is purchased from an unauthorized retailer, we cannot guarantee the safety, quality, or efficacy of the product. MORE TO KNOW: After examining the different organizations that certify products today, we have concluded that they allow certain chemicals and inferior substances that we, and our concept, cannot accept in good conscience. This makes it impossible for us, at this stage, to obtain certification of any kind, so we ask you as a consumer to be your own certifier and to examine the INCI thoroughly for each product you buy, so as to guarantee that you are getting the prime quality you are looking for.
